By subscribing to Thunder Machine Streaming Pro, you agree to the following terms. All sales are final. Due to the digital nature of broadcast infrastructure, no refunds are provided once resources are allocated.
1 The Nature of Service
Thunder Machine Streaming PRO provides enterprise-grade, non-tangible digital broadcast infrastructure. By accessing our Streaming Radio or HD TV services, you (the "Client") agree to use these services solely for business and professional purposes.
2 Final Sale & Non-Refundable Policy
All transactions are final. Due to the nature of digital infrastructure and the immediate allocation of global server resources, Thunder Machine Streaming PRO operates under a Strict No-Refund Policy.
- Initial Payment: Setup fees and the first month's subscription are non-refundable once the signal uplink is established.
- Digital Content: There are no refunds or credits for partial months of service, downgrades, or unused bandwidth allocations.
- Resource Reservation: Because we secure dedicated global CDN pathways for your broadcast that cannot be reversed, we do not offer money-back guarantees for dissatisfaction or change of mind.
3 Service Level Agreement (SLA)
While we aim for "Covering the Planet without Interruption," our technical liability is limited:
- Uptime Objective: We strive for 99.99% availability. However, service does not include outages related to the Client's local power supply or third-party internet service providers.
- Performance Metrics: Latency and throughput are monitored. If performance falls below the "Pro" threshold for more than 48 consecutive hours, the Client may be eligible for Service Credits toward future billing, but never cash refunds.
4 Client Responsibilities
The Client is responsible for all content broadcast through their account. Thunder Machine Streaming PRO reserves the right to terminate service immediately, without refund, if the broadcast violates international copyright or broadcasting laws.
5 Broadcast Compliance & Content Liability
- Content Responsibility: The Client assumes 100% legal and financial responsibility for all audio and video content transmitted through the Thunder Machine Streaming PRO network. This includes, but is not limited to, music royalties, broadcast licenses, and localized media regulations.
- Licensing Warranty: The Client warrants that they possess all necessary rights and licenses (e.g., ASCAP, BMI, SESAC, or local equivalents) for any copyrighted material broadcast. Thunder Machine Streaming PRO acts strictly as a technical conduit and does not provide or verify broadcast licensing.
- Indemnification: The Client agrees to indemnify and hold harmless Thunder Machine Streaming PRO from any legal claims, fines, or damages resulting from copyright infringement, defamation, or illegal broadcast content.
- Immediate Termination: Violation of international copyright law or broadcasting standards is grounds for immediate service termination without notice and without refund of any kind.
